After Senate setback, Obama quietly moving forward with gun regulation

A Bureau of Alcohol, Tobacco, Firearms and Explosives Final Rule published today in the Federal Register and a news release issued Friday by the Department of Health and Human Services, followed up with a notice to be published tomorrow, are two developments all but ignored by the mainstream press even though Vice President Joe Biden announced last week that the administration would be using executive orders to advance “gun control” goals following a Senate battle that could not muster the votes to do so legislatively.

The Importation of Defense Articles and Defense Services — U.S. Munitions Import List references executive orders, amends ATF regulations and clarifies Attorney General authority “to designate defense articles and defense services as part of the statutory USML for purposes of permanent import controls,” among other clauses specified in heavy legalese requiring commensurate analysis to identify just what the administration’s intentions are. Among the speculations of what this could enable are concerns that importing and International Traffic in Arms Regulations may go forward to reflect key elements within the United Nations Arms Trade Treaty.

The clarification in deference to the Attorney General on ITAR matters makes fair the question of why Eric Holder, then-Secretary of State Hillary Clinton the Department of Justice Office of Inspector General and Congressional overseers were conspicuously disinterested when export violations were pointed out as matters for Fast and Furious investigators to concern themselves with.

Meanwhile, the HHS news release pledged “Obama administration moves to remove barriers to firearm background check reporting,” by “initiat[ing] a rulemaking process to remove unnecessary legal barriers under the Health Insurance Portability and Accountability Act (HIPAA) Privacy Rule that may prevent states from reporting to the National Instant Criminal Background Check System (NICS).”

Recent allegations that medical records in New York State are being cross-referenced with gun owner handgun permit records may raise a flag of concern that this could be a first step toward setting up a national system, dependent only on a change in current prohibitions to allow records already being created to be consolidated, with the second step being the so-called “universal background check”

As the HHS Advance Notice of Proposed Rulemaking is not scheduled for publication in the Federal Register until tomorrow, Gun Rights Examiner has uploaded a copy of the draft to its Scribd document archive website account.

“The ANPRM will be available for review at: http://www.federalregister.gov/,” the HHS presser informs, anticipating tomorrow’s official publication, and further advises “Comments can be submitted to http://www.regulations.gov/.”

IMPORTANT UPDATE AND ACTION: See “Proposed HIPAA privacy rule on gun background checks open for comments,” then provide those comments and recruit fellow gun rights advocates to follow suit.

    Have any of the Americans noticed that effectively you do not need all those creeps in the senate, so you would not have to pay them either out of your taxes, a MAJOR saving, because Obama bin Laden just bypasses any law that is not passed by congress throug his Executive order plans because HE wants it.       Though I agree with you to a point, we do not need those politicians who have gone rogue and no longer serve the needs of the people of the United States, specifically the majority.
      For too long the members of the US Government have been serving their elite masters and undermining the republic by creating entire generations of people who live on the government dole.
      I am disabled and I WANT TO WORK! Yet I cannot because the VA considers my condition “unemployable” I taught for 7 years, I can still teach. Yet I am not allowed. So I am here doing what I can.
      Large countries need government, just not this kind of government. It is a fact that democracies are doomed to fail, simply because the elected leaders in short order learn that by abusing the system they can through voting alter the system to serve their needs. Like something as simple as voting pay raised for themselves or by voting that their health care is a cut above that of the people.
      They can by their “semi legal” activities vote government contracts which by all means are a “conflict of interest” in which they benefit from the transaction.
      In essence they hijack the system and turn it into a cash cow. In short order because there is not a system of checks and balances and through “corporatization” they easily determine the cash flow that primarily benefits themselves. Corporatization creates legal “entities” that are considered legally separate from their owners. Once this is done then the system begins to fail slowly and then after a while it snowballs until we have what we have today.

      Why would the political elite want to destroy the country? Why would they “create” an entire lower class and keep it growing?

      It is simple. Because “educated” (meaning college trained) people are of the impression that their training makes them better or above the less educated. In short order they begin to look down on the lower classes. It is seemingly like a “power trip”.
      If the lower class expands then more and more money becomes centered on the wealthy. Remember no credit is given to those who became unemployed regardless of their education. Thar unemployment is considered a failure of their ability to keep employment. It is never considered that their failure of employment has been engineered by an unscrupulous elite that with political assistance has shipped jobs overseas where the employ persons for less wages. Who at the same time live at a lower cost of living to begin with. It is all with the intent to garner wealth regardless of who actually does the work.

      The entire concept of allowing illegals into the country and granting them “amnesty” is because the illegals work for less, they also do not pay taxes and they get free medical care paid for by the taxpayer. Here in South Carolina I have witnessed up to 20 illegals living in a bunk room in a garage. Each pays a weekly “rent” which is a fraction of what any homeowner has to pay and the illegal retains a greater portion of their income to either send home or to party on. Remember the cost of living where their home is is a tiny fraction of what we have here and they quickly realize that if they build savings they can go home after a year or two of labor and live like a king for a year.

      Taxation increased by 2% last month who gets hit the worst? The middle class. Why? because the poor in essence do not pay taxes and at the end of the year they get the majority of what the have paid back and through “earned income credit” many get much more than they paid in back. Illegals who do not pay taxes file and actually have gotten up to $28 thousand back by claiming children that possibly live in their home countries as dependents.

      Taxation of the elite? Remember that corporatization I mentioned? Through that the elite create tax shelters and loopholes through which the majority of them claim “losses” and in essence get away without paying much of anything. With legal assistance they can make a non existent million dollar loss look like they paid tens of millions in taxes. Of course these are spread across many owned corporations and that makes it look even more legal.

      The intent in the long run is to wipe out the middle class and in essence enslave the lower caste. That is where we are heading and remember if you do not work directly for the elite you are considered a “useless feeder”, their term.

    It is their intent to restrict or remove our legal right to keep and bear arms while at the same time removing restrictions (checks and balances) to their doing so.

    The US Government does not represent the people. They represent the wealthy paying Elite.

          I would run for office, but not in this already broken system. A new system needs be created, based on the original Constitution and including term limits as well as checks and balances that guarantee when someone gets carried away they lose whatever benefit they have garnered.
          I personally believe in a council system where all members are voluntary and voted in.
          Where the loss of one individual has no major impact on the system. Where their costs are covered by the people and where gross negligence is cause for immediate dismissal.

          Politicians should not be allowed to become wealthy serving themselves. Transparency is paramount and all dealings should be publicly available. Live broadcasting and an internet based feedback system that allows the people a greater freedom immediately.

          Today we have no voice in events, we are told we do but in reality we do not. No more “voting districts” we have a social security system that though usurped still provides a functional system for checks and balances though the criminal element needs removed from those roles.

          Obama is a problem, but he is not THE problem. The problem lies with a Congress and senate that are complicit in illegal dealings. The US Government has gone rogue and is a threat to the republic of America.
