An eyewitness to a fatal police shooting in Culpeper, Virginia is contradicting the State Police version of the story.

Kris Buchele says he saw a Culpeper Town Police officer shoot 54-year-old Patricia Cook to death in the Epiphany Catholic School parking lot at around 10 a.m. Thursday, February 9, according to a WUSA report.

Buchele is a carpenter who was working on the house next door. He says he heard loud arguing outside and looked through a window where he had a clear view of the school parking lot. Cook was in her Jeep Wrangler .

State police say Cook rolled up the window, catching the officer’s arm inside, and then dragged him.

Buchele says it didn’t happen that way. He describes an encounter which looked and sounded like the officer shooting a person a point blank range, not because he feared for his life, but because the woman did not obey his order to stop rolling up the window.

“He was right next to the vehicle. He had one hand on the door handle and one hand on his weapon. And she was rolling the window up. And they were exiting out of the parkng lot.

The window was half way up he said ‘stop or I’ll shoot.’ I really didn’t think he was going to do it. But she got the window all the way up and that’s when he shot. And then she took a left out of the parking lot here and he stepped out in the street and fired five more times,” said Buchele.

    Authority is no replacement for morality. He needs to be imprisoned and tried for 1st degree murder.
    We do not know the whole story and we may never know. However he screwed up and it is time for justice in this crime against humanity.
    A badge does not give you the right of judge jury and executioner.
    What was the “probable cause”? What was the justification? Just because he sad so? I would like to know more.

    CULPEPER, Va. — There was shouting, the police officer had his gun drawn and the Jeep Wrangler was rolling across a parking lot, said Kris Buchele, who took notice just in time to witness the deadly climax between the officer and a Sunday school teacher.

    The officer, jogging alongside the Wrangler, tapped on the driver’s-side window with his gun as Patricia Cook rolled it up, Buchele remembered, and then the order came in a booming voice: “Stop or I’ll shoot!”

    The Jeep kept moving, and the officer fired at point-blank range into the Jeep, Buchele recalled. He said that Cook made a left and that Officer Daniel Harmon-Wright darted into the street, taking five more shots at the back of the vehicle as it drove away.

    Adam Forster, another witness, saw the Wrangler plow into a telephone pole. Cook, 54, of Culpeper, was declared dead soon after on that February morning.

    “Why did she do it? Why did she do it?” Forster recalled Harmon-Wright telling other officers who arrived.

    Buchele’s and Forster’s accounts were key to a special grand jury in Culpeper County issuing a rare indictment against a police officer this week: committing murder while in the line of duty.

    But an attorney for Harmon-Wright, 32, of Gainesville, offered a dramatically different version of events, saying eyewitnesses saw only the tail end of the encounter. He said his client, a former Marine and Iraq war veteran, fired because he feared for his life. By Daniel L. Hawes’s account, Cook was the aggressor and might have been seeking to take her own life.

    When Harmon-Wright fired, Hawes said, his fingers were trapped in the window of the moving Jeep and Cook had refused his order to stop.

    A community shaken

    The killing has shaken and outraged the 16,000 residents of Culpeper, a town that has not had another fatal police shooting since its department was created in 1956. It has also left an enduring mystery: How could an encounter between a homemaker with no criminal record and a police officer responding to a routine call end in death?

    “I miss the conversations, making plans to go here or there, no longer having a future to look forward to,” Gary Cook, Patricia Cook’s husband, wrote in an e-mail to The Washington Post. “It’s very lonely at home. The apartment is dark, quiet. There’s no cheer in my life.”

    The encounter between Harmon-Wright, who is apparently a graduate of Vienna’s James Madison High School, and Cook began early Feb. 9. Harmon-Wright was dispatched to investigate a report of a suspicious person in the parking lot of Epiphany Catholic School about 10 a.m.

    “One of the school staff noticed a woman circling the building,” said Michael J. Donohue, spokesman for Diocese of Arlington. “That seemed odd to staff. One of the staff asked her to leave and she refused, so they called police.”

    In the account provided by Harmon-Wright’s attorney, the five-year police veteran approached Cook’s vehicle and asked for identification. As Harmon-Wright reached inside the car to grab it, Cook began rolling up the window, trapping the officer’s fingers, Hawes said. Cook put the car in gear, Hawes said, and Harmon-Wright jumped up on the running board as the Jeep began moving.

    For about 50 yards, Hawes said, Cook began alternately slamming on the brakes and hitting the accelerator.

    Harmon-Wright ordered her to stop and then shot her with the gun in his free hand when she failed to do so, Hawes said. Hawes added that the additional shots were “more than necessary” but said his client was defending himself.

    “All of this happened in the space of three seconds. He was pretty well panicked,” Hawes said.

    But the attorney contends that it went beyond that. He said Cook was depressed and looking to take her own life via a confrontation with police.

    Greg Webb, an attorney for Cook’s husband, said that those claims are baseless and that the accusation amounted to an attempt to blame the victim. Gary Cook is pursuing a $5 million civil suit against Harmon-Wright.

    Webb said he believes that Harmon-Wright “snapped.” “Five shots seem beyond the pale,” he said. “When you start firing that many times, it makes you wonder what’s going on. Anger? Frustration?”

    Soon after the killing, Culpeper Police Chief Chris Jenkins asked the Virginia State Police to investigate. Authorities initially said that Harmon-Wright’s arm was trapped and that he was dragged during his encounter with Cook. But Jim Fisher, the special prosecutor appointed to investigate the case, said that description was inaccurate.

    “These words, ‘trapped’ and ‘dragged,’ were not words that would I use,” said Fisher, who declined to discuss additional details of the case.

    In addition, Patricia Cook’s husband, Gary Dean Cook, told MyFoxdc.com News that his wife’s car did not have power windows.

    Meanwhile, those who knew Cook cannot believe that the easygoing woman could have done anything to cause a police officer to fear for his life.

    “I don’t see her doing anything to provoke [the incident],” said Tonya Searsoss, a close neighbor in the Friendship Heights subdivision where the Cooks live. “There was not a mean bone in her body. She was very sweet. My kids loved to talk to her.”

    Eastern View High School Activities Director Mark Settle said he knew Cook because they both went to the same church, Culpeper United Methodist.

    “She liked to work in the kitchen and she was very fanciful when she baked her cakes and cookies,” Settle said. “I think she sometimes sang in the choir.”

    Two days after the shooting there are many more questions than answers. Why was Cook, who according to published reports had never been in trouble with the law, parked in the Epiphany Catholic School parking lot on East Street?

    Why did school officials consider her a suspicious person and call the police?

    Why did Cook roll up the car window and start to drive away?

    Why did the officer feel it necessary to fire as many as seven rounds at a woman who had no weapon and lived in an apartment complex less than two miles away?

    These are questions that have been repeated over and over again by Culpeper residents since the shooting occurred.

    With the incident still under investigation, the state police are giving no answers.

    The officer involved, who was reportedly slightly injured in the incident, has been placed on routine administrative leave.

    [Harmon-Wright claimed] that he was responding to reports of a suspicious woman sitting in her vehicle on the school’s property, and that when he went to take Cook’s license, she rolled up his arm in her Jeep’s window and drove off, dragging the officer and forcing him to shoot.

    Kris Buchele, a carpenter who was working near Epiphany on Feb. 9, told WUSA9 the week of the shooting that “[Harmon-Wright] was not dragged and that he shot [Cook] before she drove away”; that “he didn’t have his arm caught because the officer’s left hand was on the door handle and right hand was holding a weapon”; that “he distinctly saw her roll up the window all the way before the officer shot out the glass and killed her.”

    As I’ve written before, this could’ve been avoided if Harmon-Wright had been properly screened for the job:

    Soon after Harmon-Wright was arrested, it was revealed that he had a tarnished military record, a drinking problem, and a history of harassing Culpeper residents. The first two problems nearly kept him from getting the job, and no one at the Culpeper Police Department will say why they didn’t.

    I’m not a big fan of locking people in cages, but I find it appalling that Daniel Harmon-Wright is going to do three years for murder while Cook got the death penalty for trying to avoid a confrontation.

    Hey Pakalert! The Authorities are doing it well enough on their own. They do not need your help nor sensationalism. Post the whole story and not a small part.

    I’ve always supported law enforcement but this crap is getting over the top ridiculous. I believe our law enforcement agencies are hiring, instead of the best of the best; whoever they can get. The state of mind behind a law enforcement officer should be first and foremost above any and all: service to the community and protection of community. That INCLUDES the people whom they find themselves interacting with in the carrying out of their official duties on a day to day basis. This includes the situations that are not pleasant.

    I think what you are seeing is law enforcement agencies hiring men and women who have some kind of a authority trip. A god complex. Do what I say or ELSE. Why? Because I have a badge and if you don’t do what I say I will shoot you. Or at least beat the crap out of you and then charge you for resisting arrest.

    The second type person our leas are hiring is men and women who are reactionary. Scared of their own shadow. This makes for a deadly combination. We live in troublesome times. And that can be scary for law enforcement officers. However, in such a time it is NECESSARY for these agencies to hire people who are cool headed and rock steady. Men of courage with a heart of valor. Not men of fear with a Napoleanic complex.

    We MUST stop allowing are leas from hiring cowards, bullies and Napoleans. These type people do NOT SERVE the interest of the public. They contribute to the problem.

    I’m thankful still for the hopefully majority of leos out there that ARE the men and women that they should be. Cool headed, steady and brave; with a heart for service to the people. And a merciful and just heart. THESE are the men and women we need more of. The ones that will run into gunfire to save a life instead of being the one that takes it.

    Sometimes it is necessary to take a life in the line of duty. But this should be ONLY in the most extreme of cases. Not a Sunday School teacher who attempts to ignore you.

      I’ve always supported law enforcement but this crap is getting over the top ridiculous. I believe our law enforcement agencies are hiring, instead of the best of the best; whoever they can get.

      Considering what they pay for people to put their lives on the line just like the military they will not get “the best of the best”.
      However on the other end of the spectrum – politicians get paid amazingly well (because they vote themselves pay raises) and we get representatives like Hank Johnson of Georgia who was worried that having 7000 marines on Guam would capsize the island because of over population, tipping it into the sea. Then we also get Barry Sotero who claims during a tight and racially explosive situation that “If I had a son it would have looked like Trayvon”. Really? Where is the common sense?
