Video: Fourth Amendment Dead in Los Angeles

In Los Angeles, and much of the rest of the country, the Fourth Amendment is irrelevant. In the video below, a Los Angeles cop threatens to search a rental car because she has an issue with its “tatted up” occupants. She has not witnessed a crime, does not have probable cause, but wants to search the car because she has an emotional issue with the driver and his passenger.

This is America, circa 2013. Respect for the Constitution and the Bill of Rights is dead. In fact, awareness of the Constitution, the Declaration of Independence and the once hallowed principles of natural rights, the right to be left alone unless one poses a threat to others, and respect for the individual are long gone.

Note: the video contains explicit language, mostly on the part of the cop. Except for the blue uniform, she is indistinguishable from any other territorial and tribal gang-banger in South Central Los Angeles.

    She looks like a spic piece of shit on a power trip. All I can say is that any White worth a fark still left in Cali is a total idiot and deserve everything they get. The place is not only a liberal sewer but also a racial sewer.

    Well this just may remove her from her job and that would be fine by me. Her conduct was out of line, and threatening, without appropriate authority. If she was a rent-a-cop she has no authority whatsoever. She can detain but cannot arrest and her job will remain in the balance considering illegal detention which can be construed as kidnapping if there is no probable cause. Her assumption that “Tatted up” means anything other than “body art” is stereo typing and profiling. If she is not a trained profiler capable of identifying gang tattoos her profiling means squat.
    Authority does not replace morality assumed authority means even less and at some point will cross the border into criminal action.
    I am glad the individual in the car had the intelligence to record the session and for that I thank her.

    Since the video does not give any more data than what is actually visible I will not jump to conclusions as to reasoning or motivation.

    Is the driver a gang banger? I have no clue. Did she have just cause? Apparently not because she let them go. Did she have probable cause? Also apparently not.
    Will this kind of activity come back to bite her in the as$? I would bet on it.

    I do not know her level of training or her level of responsibility. I can only go by what is witnessed.

    As for Kurt Nimmo the author, I can only assume that he is going on his instinct as well as assume there is some sort of bias. Whether that bias is misplaced or not I cannot determine readily with this video.

    After viewing the video several times, it was noticed that the uniform patch does not appear to be that used by Los Angeles Police Department. I will leave it to someone from LAPD to clarify that further. In fact, the woman may have been a private security guard assigned to the parking lots of the rental car agency. Still, her conduct was not out of line for dealing with suspicious activity in her assigned area. She gets paid to make such observations and ask questions.

    Kurt Nimmo, author of this biased article is full of crap regarding a vehicle stop by Police in the Los Angeles area. In fact, the Officer handled herself well, considering the atitude of the person she was dealing with. The Officer explained the reason for the stop which was legitimate, was friendly and told the driver he could leave. When she asked a question, which Officers get paid to do, the driver displayed an attitude and started to get in her face. Personally, I would not have been so benevolent with the guy. In my years as a Field Officer, that guy would have been out of the car and assuming the position in a blink of an eye. They (he & passengers) would have been patted down for weapons, run for wants and warrants and been interviewed individually as to why they were there. I would have checked for vehicle burglaries or other evidence of a crime in the area. I would have walked around the vehicle, making an open view check to develop cause to search the vheicle. This is something that any Cop who has worked the streets for more than three months should be able to do in about fifteen seconds? Yep, I would have followed the letter of the law (Fourth Amendment), but chances are with a tatted banger type, cause for the search would have been developed. While I know this is hard for a regular citizen to grasp, what was just described is nothing but basic field police work. Officers do it multiple times a day. Sometime, people check ok, are thanked for their cooperation and sent on their way. Other times, the suspect has just committed a crime, an arrest is made and stolen property recovered. What the author of this piece fails to comprehend is the nature of the environment in which we live and how many predetors are powling the streets just looking for their next victim. Officers, like the woman shown in the video are the highly skilled professionals who devote their time and effort to remove such criminals from society. Be thankful they are there and consider the options if they wern’t.

      and attitudes like ^^^ is why our prisons are overfilled, and our citizens don’t trust those who are supposed to “protect and serve”. police officers are not to antagonize any persons, they are not to have thin skin as to get irritated simply because someone didn’t respond with a curtsy or the way they preferred them to, they are not here to barrage our citizens, harass our citizens, profile our citizens, stereotype our citizens, chastise our citizens….they are simply here to SERVE our citizens, and PROTECT them from any form of danger when they are called upon to assist. unfortunately in this 21st century, our police officers does everything EXCEPT protect and serve…they are officially against the citizens, and are treating us as enemies of every state. the day children become afraid of the “safe officers”, is the day officers are no longer safe.

        You have a very simplistic attitude, in a not so simple world. On the other hand, you may well be just be another liberal eltie who dwells in a secure environment while spouting the propaganda; would’ve, could’ve, should’ve?” Either way, you are entitled to your opinion, but I can tell you from thrity five years of job experience, a majority of people in the country do not agree with you. The prisons are overflowing, not because of anything the Police do or their attitudes. They are full because of a decline of family values, work ethic, parental role modeling, the education system and a desire to take the easy path rather than the one requiring hard work, honesty and integrity. Add to that a fairly lenient Justice System and a certain segment of society quickly realize that “Crime Does Pay.” According to your playbook on how Police are suposed to respond, I would concur in about 80% of the cases of public contact. In today’s society Police Officers are more community problem solvers than crime fighters and in most places have been trained to respond accordingly. In some places however, primarily metropolitian and inner city areas, Police are so bsuy dealing with the other 20% of the element, they have little time for community interaction. My personal rule of thumb on the job was regardless of the stuation or the person I was dealing with, I would start off our contact treating him/her with the same level of respect I would want if the roles were reversed. Then, depending on the response of the individual, that interaction could either go up or down. There is among the 20% element some who hate authority, refuse to cooperate and will kill another person in the blink of an eye if they think they can get away with it. They understand one thing and one thing only, “Survival of the Fittest.” It is critical that Officers quickly recognize when they are dealing with this kind of person and employ the right tactics. Yes, that being the iron fist, letter of the law approach clearly establishing the Police as the “Fittest?” I stress that this is not a routine encounter, nor does it happen on a frequent basis, but is one of the many hats a Police Officer must wear, in doing their job. Most Officers pin on the badge to “serve and protect” citizens and lay down their lives for them if necessary. I wonder if you have the same level of committment and dedication, or do you just like to second guess and arm chair quarterback a game which you know nothing about?

            Since I speak from the world of reality as someone who has been there and done that, while you on the other hand, make assumptions biased likely on a negative contact with Police, it would appear that the pot is calling the kettle black on who is delusional. Just wanted to point that out and I won’t keep you because it is probably time for the attendants to give you your meds.
